|
Noting the need for the government to be able to take property for public use.
Be it resolved that any property may be seized by the government for use (otherwise known as Eminent Domain). The following criteria apply to all cases of Eminent Domain:
- The government must give the property owner no less than thirty (30) days notice before the eviction from the property.
- The government must give the land owner no less than the appraised value of the property.
- The government must give reasonable cause as to why the property must be seized. This entails that the government have already approved and have paid for the project, building, or other use that is to be done on or to the seized property.
- The property owner may appeal to the Ministry of Internal Affairs for an extension in the case that the property owner needs more time to move their possessions off of the property to be seized.

Mr. Speaker,
While I certainly do not approve of the idea of eminent domain I do see the need for this legislation. Eminent domain is something that allows the government to use otherwise filled property for vital government works. This bill is also fair in that the owner is given full market value (more than they would likely get if they actually sold it). While i do not agree with the time frame (30 days is not enough time in my opinion) I will say that the time frame is more than what some other countries give. I also assume that this would only be used in extreme circumstances. I yield the floor.

Acting as Speaker I must ask that His Grace, the Grand Duke of Arlington follow the proper debate etiquette as demonstrated by His Grace, the Grand Duke of Valoria. Thank you, and please resume debate.

Mr. Speaker,
I must agree wholeheartedly with His Grace, the Grand Duke of Arlington. We cannot give the government the power to take away people's homes for any reason. "Vital government projects" has the possibility to be used for anything and I will not support a proposal that gives this government the power to suddenly take people's property for any reason they deem to be "vital."Even if the language used were more descriptive and clear I could not support this proposal for the simple fact that it violates basic property rights. I yield the floor.
