- Degree of Crime system:
- Definitions:
- Premeditation: planning an act before the act actually occurs
- Intention: performing an act purposely, ie the act was not an accident
- Deliberation: during the course of the act, the person had a chance to think about what they were doing and yet continued with the act
- 1st Degree is any crime that was premeditated, intentional, and deliberate
- 2nd Degree is any crime that was not premeditated but was intentional and deliberate
- Voluntary Crime is any crime that was done intentionally but not premeditated or deliberate
- Involuntary Crime is any crime that was not intentional, premeditated, or deliberate but was done nonetheless.
- Misdemeanor/Felony Distinction
- Felony: Any crime that carries a penalty more than or equal to six (6) months imprisonment or a fine more than or equal to £500,000
- Misdemeanor: Any crime that carries a penalty of less than six (6) months imprisonment or a fine less than £500,000
